Battle24-7.com is a venue for Skill Gaming. Cash and prizes can be won by playing in tournaments and multiplayer games.  These games have a small entry fee. We do not host the games or participate in the games we simply arrange the meetings.

Agreement

1.1. By using Battle24-7 you agree to be bound by these terms, which shall take effect immediately on your first use of Battle24-7. If you do not agree to be bound by all of the following terms please do not access, use and/or contribute to Battle24-7.

1.2 Changes to this Agreement
Any changes to these terms will be announced in the news section of the website. It is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions. Any games scheduled prior to the changes will be subject to the previous  terms and conditions.

2.1Battle24-7 is restricted to individuals of legal age as determined in the jurisdiction in which the individual resides. The Player cannot play under any circumstances if she/he is not at least eighteen years of age, of sound mind and capable of taking responsibility for his/her own actions.

2.2. You are entirely responsible for maintaining the confidentiality of your password and account and you have sole responsibility for any and all activities that occur under your account. You remain liable for losses incurred by yourself or a third party on your Battle24-7 account.

2.3. The onus is on you to ensure that it is legal to participate in skill-gaming for money in your jurisdiction of residence or the jurisdiction you are playing in at the time.

2.4. Your use and interest in Battle24-7  is personal and  you are only using the website for your own private entertainment and not acting on behalf of a third party.

2.5  All monies used by you in the Games are lawfully yours and are not obtained from an illegal source or through illegal activity.

2.6 You acknowledge that there exists a risk of losing money when using the Games.

2.7 You are solely responsible for recording, reporting, paying and accounting to any relevant governmental or taxation authority for any tax or other levy that may be payable on your winnings from the Games

2.08. You will not try to make alterations or introduce any kind of virus or malicious code to the Website.

2.09. You agree to use Battle24-7 only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of Battle24-7. Prohibited behavior includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within Battle24-7.

2.10 The Player is only permitted to enter the Battle24-7 for his/her own personal entertainment and non-professional use. Any other entrance, access, use or re-use of the Casino or the Web site is strictly prohibited.

2.11 Employees of Battle24-7, its licensees, distributors, wholesalers, subsidiaries, advertising, promotion or other agencies, media partners, retailers and members of the immediate families of each are not eligible to participate in the games.

2.12 If you decide to become a Member, or to enter a money challenge, the Battle24-7.com Service will be made available for your use as soon as your email address is confirmed. As a result, you will not have the right to cancel this Agreement, or to any refund of monies you pay, during any cooling-off period under the United Kingdoms Consumer Protection (Distance Selling) Regulations 2000.

2.13 You undertake to register for the Battle24-7.com Service using accurate and current information about yourself. When you fund your Battle24-7 Account from Paypal, you guarantee that you are the legitimate controller of that account and that the account has available funds sufficient to cover the charges to be deducted from it.

2.14 Battle24-7.com reserves the right to monitor the location from which you are playing and to block access to those playing from a jurisdiction where the use of our site is restricted or prohibited as well as to withhold any winning not yet cashed out.

3.0 See the Battle24-7.com Privacy Policy relating to the collection and use of your personally identifiable information. The Battle24-7.com Privacy Policy forms part of these Terms of Service.

3.1 By registering to become a Member, you agree that we may display the Username you select, your match results and records and feedback left by others for you. By committing or accepting any moneys in challenges, you further agree that in our promotional efforts we have the right to publish your Username and challenge records in any media (websites, forums, newsletters, broadcasts, emails, etc.), without making any payment to you.

3.2 You agree to fully indemnify Battle24-7.com and hold Battle24-7.com harmless from and against all and any losses, costs, expenses, claims, demands, liabilities and damages however caused that may arise as a result of your (a) use of the Games or (b) acceptance of any winnings or (c) any breach of this Agreement.

3.3 You are entirely responsible for maintaining the confidentiality of your password and account and you have sole responsibility for any and all activities that occur under your account. You remain liable for losses incurred by yourself or a third party on your Battle24-7.com account.

3.4 You must notify Battle24-7.com immediately of any unauthorised use or theft of your account or any other breach of security. If requested you agree to provide Battle24-7 with evidence of such theft or unauthorised use. Battle24-7 will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge.

3.5 You are only allowed to have one account open at a time. Multiple accounts will be deleted and any funds consolidated into the original account. Repeated violation of this term could result in the termination of all your accounts and the forfeit of any outstanding funds.

3.6 If your account is terminated, any remaining funds in your Battle24-7 account will be paid into your paypal account and will incur paypals own fees. Battle24-7 reserves the right to withhold the winnings of any user who has broken the terms of this agreement.

4.0 If we suspect foul play we reserve the right to withhold cashouts until the end of the charge-back period which applies to the payment method used to pay in the relevant funds. This action will only be taken in extreme circumstances.

4.1 You agree to provide Battle24-7 with accurate information at the point of registration and to inform us of any changes to these details.

4.2. You authorise us to use any means that we consider necessary to verify your age, identity and location with any third party providers of information.

4.3 On registration via the Website, you will open a U.S. dollar-based account into which Battle24-7 will receive all funds in U.S. dollars. Depending on the payment service you use, you may incur currency Website fees, credit card fees or wire transfer. These are not charged by Battle24-7, but by your service providers.

4.4 All currency conversions will be done by paypal.  Please visit www.paypal.com for more information on this.

4.5 You are responsible for your computer’s protection from viruses and spyware. The use of a firewall is recommended.

4.6 If it is found that funds have been mistakenly credited to your Battle24-7 account, we reserve the right to reclaim those funds without notice. Any winnings mistakenly credited to your Account yet withdrawn by you will constitute a debt owed by you to Battle24-7.com.

5.0 Battle24-7.com reserves the right to cancel your account for any reason whatsoever at
any time without notice to you. Any balance in your account at the time of such cancellation will be credited to your Paypal account. However, Battle24-7.com reserves the right, to void any winnings and confiscate any balance in an account in any of the following circumstances:
I) If you have more than one active account
II) If the name on the your  account does not match the name on the Paypal account;
III) If you  provide incorrect or misleading registration information;
IV) If you are not of legal age;
V) If you reside in a jurisdiction where participation in skill based games is prohibited by law;
VI) If you have allowed or permitted (intentionally or unintentionally) someone else to play on your account;
VII) If you have not played at Battle24-7.com on an individual basis for personal entertainment only (that is, you have played in a professional sense or in concert with other player(s) as part of a club, group, etc.);
VIII) If you have "charged back" any of the deposits made with your Paypal account;
IX) If you are found cheating

5.1 If there is a Disputed result on a match between two players, and players are unable to resolve the conflict the within the automatic 24 hours reporting extension provided, each player will be refunded his or her entry fee minus the administration fee. Each player will also receive a ‘Strike’ on our records.
In the event of a disputed result in a multiplayer match involving more players, Battle 24-7.com will investigate the claims and will reach a decision as to the outcome, which will be final and unappealable.

5.2 About Strikes:
After receiving three strikes a player’s membership will be reviewed and he/she will be permanently banned without recourse if foul play is suspected. The outcome of the review is at the discretion of Battle24-7.com and no discussion will be entered into.
Battle 24-7.com may decide to remove a Strike off a player’s record after 10 matches played in good conduct on the player’s part and a review of said player’s profile.

5.3 All copyright, trade marks, design rights, patents and other intellectual property rights (registered and unregistered) in and on Battle24-7.com and all content (including all applications) located on the site shall remain vested in Battle24-7.com or its licensors. You may not copy, reproduce, republish, disassemble, decompile, reverse engineer, download, post, broadcast, transmit, make available to the public, or otherwise use Battle24-7.com content in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from any Battle24-7.com content except for your own personal, non-commercial use. Any other use of Battle24-7.com content requires the prior written permission of Battle24-7.com.
5.4 The names, images and logos identifying Battle24-7.com or third parties and their products and services are subject to copyright, design rights and trade marks of Battle24-7.com and/or third parties. Nothing contained in these terms shall be construed as conferring any license or right to use any trade mark, design right or copyright of Battle24-7.com or any other third party.
5.5 By sharing any contribution (including any text, photographs, graphics, video or audio) with Battle24-7.com you agree to grant to Battle24-7.com, free of charge, permission to use the material in any way it wants (including modifying and adapting it for operational and editorial reasons).

5.6 You further agree that you will not submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Battle24-7.com all of the license rights granted herein.

5.7 Abuse of the Battle24-7.com Service. Members may not use unfair methods on the Battle24-7.com Service. Any technique which facilitates a Member to deploy anything other than pure skill in the conduct of a game is unfair for these purposes. Such techniques may include, but are not limited to, multiple Accounts (see Clause 3.5 above), the use of program codes or commands or any adapted hardware or software to assist play, the impersonation of another Member, or deliberately losing games for the purpose of getting a competitive advantage. Further, Members may not conduct themselves in such a way as to produce a disruption or malfunction of the Battle24-7.com Service.

5.8 Members must not access Battle24-7.com, or information gathered from it, for the sending of unsolicited bulk email (sometimes known as spam).

5.9 Any Battle24-7.com members who do not visit the site for  12 months, are not contactable with the details they have provided and who have funds in their account will forfeit the funds. These funds will be donated to the charity of Battle24-7.com’s choice.

5.10 In the event of the cancellation of a match by Battle24-7.com (for example, but not exclusively, when only one player is signed up to a multiplayer game) for any reason, all stakes including the admin fee will be refunded to each player’s Battle24-7 account.

5.11In the event a player would like to withdraw from a match, he/she can do so by emailing us details of the game up to one hour before the start of the match.  All entry monies for that match will then be refunded to his/her Battle24-7.com account.

5.12 Once an event is completed, all players from all matches should report the result on the Website, stating truthfully who has won the match.

5.13 If all players report and the reports agree, then as soon as all reports are made, the winnings (less Battle24-7 commission) are paid to the agreed winner. The loser loses his or her stake and any commission taken.
You accept that any amounts lost by you under any challenge with another Member are transferred to that Member and will not under any circumstances be recoverable from the Company.

5.14If only one player reports the result, that player’s report is regarded as the correct result and winnings will be paid accordingly at the end of the 24 hours reporting period.

5.16 Winnings may be paid within 24 hours if all the players have reported on the outcome. If not all players have reported on the outcome, winnings will be paid no sooner than 24 hours from the end of the match.

5.17All results must be reported within the 24 hour period. If the match’s winnings are paid to another member other than the winner, based on their report of the result, and as a result of the other players’ failure to report the match’s outcome within the 24 hour period, the transfer of funds will be final. Any attempt to report after the winnings have already been awarded will not be accepted and will be null and void.

6.0 Battle 24-7.com shall have no liability to you in respect of an event of Force Majeure. For the purposes of this Agreement "Force Majeure" means any event outside the reasonable control of a party affecting its ability to perform any of its obligations under this Agreement.
6.1All Battle 24-7.com services are provided to you “as is", without warranty of any kind, either expressed or implied, including, but not limited to, implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, or non infringement of third party rights. Battle 24-7.com do not warrant that any of the services offered will meet your requirements or be uninterrupted or error free or secure or that any defects are correctable or will be corrected. The entire risk as to the use, quality and performance of all services provided lies with you.
Battle 24-7.com’s maximum liability to you or any third party arising out of this agreement or your use of the games, whether for breach of contract, equitable duty or in tort or otherwise, will be limited to the amount, if any, you paid to access the games.   Nothing in this agreement shall limit the service providers liability for death or personal injury caused by their negligence.                                                                                                    In no event will Battle 24-7, their licensees, distributors, parents, subsidiaries, affiliates and all of their officers, directors and employees, nor anyone else involved in creating, producing or delivering the website or services, be liable for any damages or losses whatsoever, including, without limitation, special, indirect, consequential, incidental or punitive damages, arising out of or in connection with this agreement or the use or performance of the website or the services. This disclaimer and limitation applies regardless of the cause or nature of the losses or damages including, without limitation, lost revenue or profits (whether direct or indirect), interuptions, loss of data, inaccurate results, or delays, however arising and regardless of the theory of liability, even if the service providers received prior notice of the possibility of such damages. By accepting this agreement, you acknowledge that the nominal fee, if any, reflects this allocation of risk.
Any allowable claim, if any, which you may bring against Battle 24-7.com must be brought no later than sixty days after the date of the event giving rise to the claim, and you hereby waive any right to bring any claim not brought within such period.
If you are using any third party equipment, software or services (collectively, the "third party goods/services") in connection with your use  the website or the services, the entire risk as to the quality and performance of such third party goods/services rests with you. should such third party goods/services prove defective, you assume the entire cost of all necessary repairs or corrections.
6.2 You shall defend, indemnify, and hold Battle 24-7.com, their parents, subsidiaries, partners (including anyone else involved in creating, producing or delivering the website and services), affiliates, directors, officers, employees, and representatives harmless from and against any and all claims, demands, liabilities, losses, damages, costs and expenses, including legal fees, resulting from, arising out of, or in any way connected with: your misuse of the website, any breach of this Agreement by you, your acts or omissions, or the enforcement or protection or clarification of the Service Providers' rights under this Agreement.

7.0 Disclaimer and Release.
Battle24-7.com has no control over or responsibility for the truth or accuracy of any material available on the Battle24-7.com website provided by Members or other third parties.
- If any third party sites are linked to from the Battle24-7.com Service, this does not mean that we endorse or have any responsibility for the site in question or anything which appears on it.
- You should exercise no lesser degree of caution in appraising what you see on the Battle24-7.com Service than you do offline.
- Even though Members are prohibited from doing so, people may provide information, or otherwise behave, in a way that is unreliable, misleading or even illegal. Further, you should note that people may not necessarily be who they say they are.
- Your use of the Battle24-7.com Service is entirely at your own risk.
Accordingly, to the extent that the law permits, you release Battle24-7.com its directors, contractors and employees from all liability arising out of or in connection with the Battle24-7.com Service and the material included here by Members and other third parties.

7.1You have the right to cancel, your account or a particular subscription at any time. You understand and agree that, except as expressly provided by law, the cancellation of your account or a particular subscription is your sole right and remedy with respect to any dispute with Battle 24-7.com

General
These Terms of Service are governed by the laws of England and Wales. You hereby irrevocably consent to submit to the jurisdictions of the Courts of  England.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Battle 24-7 arising from this agreement or your use of the Site, and Services.
These Terms of Service are written and are only available in English. If these Terms of Service are translated into another language the English version will prevail.
Battle 24-7.com may assign this agreement in whole or in part, at any time. You hereby agree that Battle 24-7.com’s licensors are third-party beneficiaries under this agreement.
If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of this Agreement shall continue in effect.
This agreement, including the documents expressly incorporated by reference, constitute the entire agreement between you and Battle 24-7.com with respect to the Services.
Battle 24-7.com’s failure to enforce at any time any of the provisions of these Terms of Service or related License Agreements shall in no way be construed to be a present or future waiver of such provisions, nor in any way affect the right of any party to enforce each and every such provision thereafter.
Notwithstanding anything else in this agreement, no default, delay or failure to perform on the part of Battle 24-7.com shall be considered a breach of this agreement if such default, delay or failure to perform is shown to be due to causes beyond the reasonable control of Battle 24-7.com.
Anti Money Laundering Provisions
A Battle24-7.com player winning $5000 over a six month period will be asked to provide us with proof of ID and Address. Only a passport scan or driving license will suffice.
